So far there’s nothing illegal about anything to do with the ones in the tubes. They were all informed of the risks, they all went in voluntarily. Them getting stuck was accidental. It’s no different than if the ferris-wheel at the carnival breaks down with you at the top. Depending on how long you’re stuck up there you may be able to sue for damages caused by faulty equipment, but you can’t charge them with kidnapping or any other crime unless you can prove that they stuck you up there on purpose. HR has, in fact, been actively trying to get them out. Even if they were to die, it would still be accidental and unless there’s evidence that HR knew that was more likely to happen than he let on the worst he could really be charged with would be negligent homicide. But even that’s a stretch so long as he was honest about the risks involved.
The only illegal things that have happened so far are the “disappearance” of one employee and the hiring of JJ, and there’s really no proof that either one was done by Hurricane. (So far at least. Some may come to light with further investigation.)

The only ones I can think of are rather speculative and would be rather difficult to get a conviction for because it would be required to prove that the five getting stuck in the tubes was intentional or known to have a high probability that was not disclosed…
A civil suit for lost wages and other damages sure. But criminal actions require intent or gross negligence. You can’t charge a carnival ride operator with kidnapping or wrongful imprisonment just because the ride breaks down. You must have proof that he did it on purpose or that any reasonable person in the operator’s position would have expected it to break down and the operator failed to warn the prospective riders of the possibility. This is essentially the same situation, it being experimental technology doesn’t really change much other than increasing the amount of risk disclosure necessary to account for the fact that the testers don’t know anything about how the system works.
The missing employee and JJ have crimes attached, but there’s not exactly a lot of evidence pointing either one to Hurricane. The only people who could testify about it are either dead or unlikely to want to talk about it…
The best Shanna and Xan can hope for if the authorities get involved is for the investigation to somehow stumble across evidence that the missing employee died in the tube room. Shanna and Xan would still probably end up in jail for their breaking and entering, assault with a deadly weapon, and kidnapping activities, and Carol could probably play dumb and blame it all on HR as long as she was reasonably careful during her cleanup operation.
Most likely the looming apocalypse will change the priorities of everyone involved however, and Carol will either not make it or agree not to press charges as long as Shanna and Xan content themselves with having rescued the five and destroyed HR and don’t make a big deal about the rest.

Ironically, Shanna and Xan are the truth seekers and could face serious consequences if Hurricane has all the legal paperwork to keep the 5 in those tubes. And perhaps death if gamers blame them for losing their favorite game.
